FREMONT, Neb. (AP) _ A judge has refused to call a temporary halt to development of a chicken processing plant for Costco Wholesale in Fremont.
Nebraska Communities United had filed the lawsuit July 25 on behalf of three Fremont residents. It alleges that the city illegally declared nearly 1,000 acres _ including around 400 acres of farmland _ to be substandard and blighted so tax-increment financing could be used for property improvements.
On Thursday the judge ruled that the plaintiffs didn’t meet their burden of proof for a temporary injunction.
The city’s interim administrator, Brian Newton, told the Fremont Tribune that both parties are hoping that a nonjury trial can
be held in December, before the holidays.
Costco and Georgia-based Lincoln Premium Poultry have said the plant would employ up to 1,100 people.
