Mitchell man to face trial regarding fatal accident

Mitchell man to face trial regarding fatal accident

A man charged with motor vehicle homicide in a fatality accident August 20th on the west edge of Mitchell will face trial in district court following a preliminary hearing Wednesday.

23 year old Joshua Bolzer of Mitchell is charged in the death of 19 year old Dereon Betancur.

During the hearing , Nebraska State Patrol accident constructionist Travis Wallace testified Bolzer’s pickup was eastbound on Highway 26 when he missed the left turn in the highway entering Mitchell. Wallace said as the vehicle left the highway, it struck a utility pole before hitting Ice Box liquor and rolling several times across the adjacent road, disintegrating into pieces that hit three tractors. Wallace said the airbag control module measured the speed of the vehicle at 119 miles per hour seconds before the airbag was deployed.

Scotts Bluff County Sheriff’s Deputy Matt Dodge told the court Bolzer’s blood alcohol content was .118, well over the legal limit, following the accident. Dodge said passenger Brandon Wiedeman told him he “knew he was going to die” as he yelled at Bolzer to slow down after seeing him traveling at 120 miles per hour when approaching Mitchell.

NSP Sergeant Monte Lovelace testified forensic pathologist Pete Schilke conducted an autopsy and indicated Betancur died from blunt force injuries, including a lacerated spleen and kidney, broken neck and damaged brain stem.

Bolzer is free on  $25,000 cash bond pending his arraignment in District Court.
