A 70-year-old rural Scottsbluff man has been accused of sexually assaulting a girl when she was no more than six-years-old.
Court documents say that Jimmy Darnell has been charged with 1st Degree Sexual Assault on a Child Less Than 12 Years of Age; a Class 1B Felony- and 3rd Degree Sexual Assault of a Child; a Class 3A Felony.
The victim was forensically interviewed in June of 2018 at CAPStone and told authorities about the nature of the assaults that reportedly occurred sometime between October, 2011 and October, 2012. Investigators say that would mean the girl was either five or six at the time the alleged assaults occurred.
Additional court documents state that there were text messages acknowledging that the girl had been sexually assaulted.
Formal charges in this case were filed Friday afternoon in Scotts Bluff County Court. A citation in lieu of arrest was mailed to Darnell ordering him to appear for his arraignment on May 24th. Online court records filed by Darnell’s attorney Maren Chaloupka state that he intends to waive his preliminary hearing.
If convicted, the Class IB Felony carries a prison sentence ranging from 20 years to life, and the Class 3A Felony carries a maximum of three years in prison.
